TERMS AND CONDITIONS OF THE ONLINE SERVICE

Effective from 11.09.2024.

Welcome to the b-energy.pl Service! We invite you to familiarize yourself with these Terms and Conditions, which contain the most important information regarding the use of the Service, including the rights and obligations of the User and the Service Provider, key rules for concluding and executing contracts, as well as information about withdrawal from the contract and submitting complaints. Acceptance of the Terms and Conditions is voluntary but necessary to conclude an Agreement.

The Service is operated by Blue Energy Sp. z o.o., based in Pomiłowo 10, 76-100 Sławno, registered in the Register of Entrepreneurs maintained by the District Court in Koszalin, 9th Commercial Division of the National Court Register under the number KRS 0000923687, with NIP: 4990687876 and REGON 520018658, with a share capital of PLN 5,000.00.

I. Definitions

The terms used in this document have the following meanings:

  • Business Days – days from Monday to Friday, excluding public holidays.
  • Application Form – a form available on the Service’s website, enabling the Candidate to submit an application in response to a Recruitment Announcement.
  • Candidate – a natural person using the Application Form to express interest in participating in a recruitment process aimed at employment or cooperation with the Service Provider.
  • Client – a natural person with full legal capacity, a sole trader, a legal entity, or an organizational unit without legal personality, to whom special provisions grant legal capacity, for whom the Service Provider provides Services electronically.
  • Civil Code – the Act of April 23, 1964 (Journal of Laws No. 16, item 93, as amended).
  • Consumer – a consumer as defined in Art. 22[1] of the Civil Code, who is a Client of the Service.
  • Recruitment Announcement – an advertisement posted on the Service aiming to find a specific employee or partner for the Service Provider, under the conditions outlined in the Announcement.
  • Entrepreneur – an entrepreneur as defined in Art. 41 [1] of the Civil Code, who is a Client of the Service.
  • Terms and Conditions – this document.
  • Online Service/Service – the service operated by the Service Provider, available at https://b-energy.pl.
  • Service Provider – Blue Energy Sp. z o.o., based in Pomiłowo 10, 76-100 Sławno, registered in the Register of Entrepreneurs maintained by the District Court in Koszalin, 9th Commercial Division of the National Court Register under the number KRS 0000923687, with NIP: 4990687876 and REGON 520018658, with a share capital of PLN 5,000.00.
  • Consumer Rights Act – the Act of May 30, 2014, on Consumer Rights (Journal of Laws 2014, No. 827, as amended).
  • Electronic Services Act – the Act of July 18, 2002, on Providing Electronic Services (Journal of Laws No. 144, item 1204, as amended).
II. General Provisions
  1. These Terms and Conditions define the general conditions, rules, and terms of service provided by the Service Provider. The Terms and Conditions are continuously available on the Service’s website in a manner that allows them to be retrieved, stored, and reproduced at any time.
  2. All rights to the Online Service, including property copyrights, intellectual property rights to its name, domain, website, as well as all templates, forms, and logos placed on the Service’s pages (except for logos and photos presented on the Service to showcase products or services, where copyrights belong to third parties, especially manufacturers or distributors), belong to the Service Provider. Usage may only occur as specified in the Terms and Conditions or with written consent from the Service Provider.
  3. The Service Provider ensures that Internet users can use the Online Service and perform all activities specified in the Terms and Conditions, using all popular web browsers, operating systems, devices, and Internet connections.
  4. The minimum technical requirements for using the Online Service are:
    • A computer or mobile device with Internet access;
    • A web browser such as Internet Explorer version 11 or later, Chrome version 66 or later, Firefox version 60 or later, Opera version 53 or later, or Safari version 5 or later;
    • JavaScript enabled in the browser.
  5. To place an order or use some services on the Service, the Client must have an active email account.
  6. The Service Provider informs that the public nature of the Internet and using electronic services may pose a risk for users, such as the acquisition or modification of user data by unauthorized persons, or harmful software being introduced into users' information systems. Clients should use appropriate technical measures, including antivirus programs and firewalls, to minimize such risks.
III. Rights and Obligations
  1. It is prohibited to use the Service’s resources and functions for activities that would infringe the interests of the Service Provider, such as advertising another business, posting unrelated content, or false/misleading information.
  2. Clients are obliged to:
    • Not provide or transmit content prohibited by law (e.g., content promoting violence, defamatory, or infringing personal rights of third parties);
    • Use the Online Service in a way that does not disrupt its operation;
    • Avoid actions such as spamming or disturbing other Clients and the Service Provider;
    • Use all content available on the Online Service only for personal use;
    • Use the Online Service in compliance with the law of the Republic of Poland, these Terms and Conditions, and general Internet usage principles.
  3. Posting content that could:
    • Violate third-party rights (e.g., copyrights, intellectual property rights, business secrets);
    • Include personal data or image without permission;
    • Be offensive or threaten other people;
    • Violate these Terms and Conditions or legal standards, is prohibited.
IV. Terms of Service
  1. The Service Provider allows Clients to use the Service free of charge, available 24/7.
  2. Clients may contact the Service Provider via an interactive form. The agreement to provide the service of enabling the Client to send messages is concluded for a specific time and terminates when the message is sent.
  3. Candidates may respond to Recruitment Announcements using the application form on the website.
  4. Consumers or Entrepreneurs with consumer rights may withdraw from the contract according to the Consumer Rights Act by submitting a declaration, e.g., using the contract withdrawal form attached to the Terms and Conditions.
V. Complaints Regarding Electronic Services
  1. Clients can file complaints about service irregularities or malfunctioning features:

  2. Complaints should include the Client’s name, address, and a description of the issues.
  3. The Service Provider will resolve complaints within 14 days.
VI. Alternative Dispute Resolution

Consumers have the option to use alternative dispute resolution methods, including applying to a consumer arbitration court, requesting mediation, or contacting consumer protection bodies such as the Consumer Ombudsman or consumer organizations.

VII. Data Protection

The Service Provider processes Clients' personal data in accordance with applicable laws and the Privacy Policy available on the Service website.

VIII. Final Provisions
  1. Disputes between the Service Provider and Clients who are Consumers will be resolved by competent courts according to the Civil Procedure Code.
  2. Disputes with Entrepreneurs will be resolved by the court of the Service Provider’s registered office.
  3. All Clients will be informed of any changes to these Terms and Conditions via an announcement on the main page of the Website, including a summary of the changes and the date they take effect.
  4. The effective date of the changes will be no less than 14 days from the date of their announcement.
Notice of Withdrawal from the Service Agreement

Right to Withdraw from the Service Agreement

We hereby inform you that you have the right to withdraw from the service agreement within 14 days without providing any reason. The withdrawal period will expire after 14 days from the date of the agreement.

To exercise the right of withdrawal, you must inform us, Blue Energy Sp. z o.o., located at Pomiłowo 10, 76-100 Sławno, registered in the National Court Register by the District Court in Koszalin, IX Commercial Division under the number KRS 0000923687, email: info@bblueenergy.pl, tel. +48 575 576 995, of your decision to withdraw from this agreement by means of an unequivocal statement (for example, a letter sent by mail or email). You may use the model withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
